These Terms and Conditions (“Agreement”) govern your use of services provided by Etihad Capital PSJC (“Company”, “we”, “us”, or “our”), a company regulated by the Securities and Commodities Authority (SCA) in the United Arab Emirates.

2. ACCEPTANCE OF TERMS
By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and all applicable laws and regulations.

3. ELIGIBILITY
You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.

4. ACCOUNT REGISTRATION
4.1 You agree to provide accurate, current, and complete information during the registration process.
4.2 You are responsible for maintaining the confidentiality of your account credentials.
4.3 You agree to notify us immediately of any unauthorized use of your account.

5. SERVICES PROVIDED
5.1 Etihad Capital provides investment and trading services including but not limited to:
– Securities trading
– Portfolio management
– Investment advisory services
– Market research and analysis

5.2 All services are subject to applicable laws and regulations of the UAE and SCA guidelines.

6. INVESTMENT RISKS
6.1 You acknowledge that all investments carry inherent risks, including the risk of loss of principal.
6.2 Past performance is not indicative of future results.
6.3 You are solely responsible for your investment decisions.

7. FEES AND CHARGES
7.1 You agree to pay all applicable fees and charges as outlined in our fee schedule.
7.2 We reserve the right to modify our fees with prior notice.
7.3 All fees are non-refundable unless otherwise stated.

8. CONFIDENTIALITY
8.1 We will maintain the confidentiality of your personal and financial information.
8.2 We may disclose information as required by law or regulatory authorities.

9. LIMITATION OF LIABILITY
9.1 To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages.
9.2 Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

10. TERMINATION
10.1 Either party may terminate this Agreement with written notice.
10.2 Upon termination, you must settle all outstanding obligations.
10.3 Provisions that by their nature should survive termination shall remain in effect.

11. AMENDMENTS
We reserve the right to modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of modified terms.

12. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates.

13. DISPUTE RESOLUTION
13.1 Any disputes arising from this Agreement shall first be attempted to be resolved through good faith negotiations.
13.2 If negotiations fail, disputes shall be resolved through arbitration in accordance with UAE arbitration laws.

15. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Etihad Capital PSJC regarding the use of our services.
